We advise insurance companies on legal implications of their insurance and reinsurance business. We focus mainly on insurance coverage, general liability, product liability, strategic planning, policy drafting and regulatory compliance. We also advise burial societies and funeral parlours/undertakers on the regulatory aspects relating to consumer rights on the funeral products they offer and associated legal risks such as the regulation (or lack thereof) of the collection of premiums which may lead to mismanagement.
We also advise and represent members of the public who took out short- and long-term insurance policies which are repudiated when insured events materialises. We assist our clients to lodge complaints with the relevant ombudsman. If our clients are not happy with the decision of the relevant ombudsman, when instructed to do so, we can refer the matter to the Financial Services Tribunal for reconsideration and ultimately to the High Court. We also regularly advise and represent clients who paid funeral cover premiums but funeral undertakers refuse to pay when insured people pass away or bury the deceased persons.
Given the importance of healthcare and the associated costs, we also advise medical aid schemes and pharmaceutical companies on the law governing healthcare, members and customers rights and associated fees, complaints, and pricing of medical products in South Africa. We also advise and represent medical aid members where their claims are unfairly and unlawfully rejected.
